The following Terms and Conditions of Sale and Use apply exclusively between Diggaz Records and any visitor to or buyer from the site www.diggazrecords.com.

These General Terms and Conditions of Sale and Use are freely available on the website www.diggazrecords.com.

These General Terms and Conditions of Sale and Use may be subject to change, the conditions applicable to the customer's order are those in force on the site www.diggazrecords.com on the date on which the said order was posted. 

These General Terms and Conditions of Sale and Use apply to the sale of all items offered on the site www.diggazrecords.com.

Article 3 - General description of articles :

In application of article L111-1 of the French Consumer Code, which provides for the possibility for the potential customer to know, prior to placing a definitive order, the essential characteristics of the articles he/she wishes to purchase, these are explained on the website www.diggazrecords.com, and this applies to any item offered for sale.

Some new products may have been unsealed to be checked so that they'll meet the requirements (version, pressing, colours, ...).

Likewise, some other products are not sealed before being distributed by producers/publishers whilst being utterly new products.

Second-hand discs are graded according to the International standard Goldmine Grading System.

Non-contractual photographs : The product may differ from the photo displayed on our website.

Article 4 - Orders :

Orders can be placed via our website: www.diggazrecords.com

The sale cannot be regarded as concluded until after receipt by the customer of a confirmation mail of the order on the one hand and the collection of its payment in full on the other hand.

As part of its control and acceptance procedure, Diggaz Records reserves the right to require additional supporting documents as well as the right to cancel or refuse any order from a customer with whom an order would have proved contentious.

Article 5 - Prices :

The prices of our items are shown in Euros (V.A.T.), shipping charges not included, and are paid in this currency (Euro) only.

Diggaz Records reserves the right to change prices at any time but will charge the item(s) on the basis of the current list price. www.diggazrecords.com at the time the order is placed, subject to availability.

Article 6 - Validation and payment :

The customer declares that they have taken notice and accept these General Terms and Conditions of Sale and Use before validating their order.

Therefore, any validation of the order by the customer constitute acceptance to abide by the present General Terms and Conditions of Sale and Use.

All transactions carried out between the site www.diggazrecords.com and its customers will be recorded by Diggaz Records and will be used as evidence if necessary. 

In order to pay for their order, the customer will have the freedom to choose from all the payment methods offered during the final validation of the order, namely :

You have the option to pay using the secure Stripe payment system that accepts Credit Card payments and is known for its reliability.

PayPal :

You have the possibility to pay from your personal PayPal account.

Transaction security :

Regardless of the payment method chosen, the bank information that the customer communicates to Diggaz Records, will never circulate in clear on the Internet.

All transactions are secure and encrypted.

No Credit Card number is retained by Diggaz Records.

The same applies to payments via PayPal.

Article 7 - Availability and deliveries :

Our offers of articles and prices are valid as long as they appear on the site www.diggazrecords.com, within the limit of available stocks.

If however an order was validated on an article which has meanwhile become unavailable, Diggaz Records undertakes to issue a credit memo or refund to the customer's convenience. The latter will have been previously notified by mail of the unavailability of the originally selected item.

The articles are delivered to the address indicated by the customer when registering on the site www.diggazrecords.com.

The order will be processed within 3 days from the date of validation of the payment of the order.

The choice of carrier (La Poste, Mondial Relay, private carrier) will be made by Diggaz Records according to the weight and/or volume of the items.

Diggaz Records reminds its customer that they are required to make sure that they have mentioned all the information relevant to the delivery of their order.

In the event that the information provided by the customer is erroneous or insufficient to ensure the correct delivery of the order, Diggaz Records cannot be held responsible.

Diggaz Records reserves the right to cancel an order if it turns out that the shipping address provided by the customer does not identify a fixed location of the buyer (e.g. P.O. Box, Hotels, ...).

Any claim, whether it is a delivery error and/or non-conformity of the articles in kind or in quality with respect to the indications on the order form, shall be expressed by the customer to Diggaz Records at the latest by the second working day following the delivery date.

Any claim made beyond this period will be systematically rejected.

Article 8 - Guarantees :

As provided by law, the client benefits from the provisions of the legal guarantee relating to hidden defects.

In accordance with article 4 of Decree No: 78-464 of 24 March 1978, the provisions here of shall not deprive the consumer of the legal guarantee which requires the professional seller to guarantee it against all the consequences of the hidden defects of the item sold.

The customer is expressly informed that Diggaz Records is in no way the producer of the items presented on the site www.diggazrecords.com, in the sense understood in Law No.: 98-389 of 19 May 1998 and relating to liability for defective articles.

Therefore, in the event of damage to a person or property as a result of a defect in the article, only the liability of the producer of the item may be sought by the customer, on the basis of the information contained in the package of the article.

Article 9 - Right of withdrawal :

The French law guarantees the buyer to have a 14-day period to retract.

Possibility will therefore be given to the buyer to return the item (or items), provided that it is (they are) in a state in accordance with that established upon its (their) acquisition.

In all cases, the shipping costs related to the return remain the responsibility of the buyer.

Upon receipt, the said return shall be the subject of a credit or refund of the amount of the returned merchandise, provided that it is in a state conforming to that established at the time of its acquisition.

The buyer shall return at his own expense the article(s) giving him no satisfaction within 14 working days.

This delay runs from the day of delivery of the customer's order.

If it happens that this period expires on a Saturday, Sunday or a public holiday, it will be automatically extended until the next working day.

In order for the buyer to enjoy the right of withdrawal, the new items must not have been unsealed.

In order for the refund to be made, the article returned must conform to its state upon its acquisition, namely in its entirety, in its original packaging, complete and intact, and in perfect state of resale.

No refund or exchange will be made for any damaged item, or whose original packaging would be damaged.

With the exception of the return charge to the buyer, no penalty shall be applied for the exercise of the right of withdrawal.

In the event that the right of withdrawal is exercised, the buyer has the choice of requesting either a refund of the sums paid or an exchange of the article.

In the case of an exchange, the redispatch will be done at the buyer's expense.

Computerized records, kept in the computer systems of each party, under reasonable conditions of security, shall be admitted as evidence of communications, contracts and payments between the parties.

Article 10 - Force Majeure :

Neither party shall have failed to fulfil its contractual obligations in the event that their performance is delayed, hindered or prevented by an act of God or force majeure.
All facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all reasonable efforts, shall be considered as fortuitous event or force majeure.

The party affected by such circumstances shall notify the other within 5 working days following the date on which it has been notified.

In order to examine the impact of the event and agree on the conditions under which the enforcement of the contract will be pursued, the two parties will then move closer, within one month, unless there is an inability inherent to force majeure.

If the case of force majeure extends over a period of more than 3 months, these general conditions may be terminated by the aggrieved party.

In addition to cases usually retained by the jurisprudence of the French courts and tribunals, are expressly considered as cases of force majeure or fortuitous cases : blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning, shutdown of telecommunication networks or difficulties peculiar to telecommunications networks external to customers.

Article 11 - Rights of use :

In terms of intellectual property law, the design and graphics of the site www.diggazrecords.com are considered an original work.

All texts, comments, illustrations of articles and images reproduced on the site are reserved under copyright and intellectual property law for the whole world www.diggazrecords.com.

In accordance with the provisions of article L 122-5 of the Intellectual Property Code, users have the possibility to make strictly private use of the website.

Any unauthorised reproduction of the site www.diggazrecords.com, whether total or partial, is strictly prohibited and constitutes an offence of counterfeiting.

Article 12 - Data processing and freedom :

In accordance with the French law "Informatique et Libertés" n ° 78-17 of 6 January 1978, the user has the right to access and rectify personal data concerning them.

Diggaz Records deals with all this information confidentially and discreetly.

Security :

Everything has been set up to ensure that the personal information transmitted to Diggaz Records is best sealed.

In case of doubt as to an intrusion into their account, the customer is required to notify Diggaz Records as soon as possible and/or to change their password from the context menu.

Sending emails :

In the "My Account" menu, the client has the option of suspending or resuming the automatic sending of the Newsletters.

In order to guarantee the confidentiality of personal information transmitted to the customer, Diggaz Records undertakes to comply with the regulations and ethical provisions on the protection of personal data.

Article 13 - Legal terms and legal clauses :

This contract is subject to the French law.

The language of this contract is the french language.

In case of litigation, only the French courts will be competent.

The information that the client communicates is confidential, Diggaz Records agrees not to disclose them to third parties.

They will only be used for the processing of the order, to strengthen and personalize the communication, in particular by the newsletters to which the customer will subscribe.

The client has a right of access, rectification, and opposition to the personal data concerning them.
