These General Terms and Conditions of Sale and Use may be freely consulted on the website www.diggazrecords.com.
As these General Terms and Conditions of Sale and Use are subject to change, the conditions applicable to the customer's order are those in force on the site. www.diggazrecords.com on the date the order was validated.

Article 3 - General description of items :
In application of article L111-1 of the French Consumer Code, which allows potential customers to know the essential characteristics of the items they wish to purchase before placing a definitive order, these are explained on the website. www.diggazrecords.comand this applies to every item offered for sale.
New products are likely to have been unsealed by us in order to ensure that they comply with the expected criteria (version, pressing, colors, etc.).
In other cases, products are not sealed before distribution by their producer/publisher, even though they are brand new.
Used discs are graded according to the international Goldmine Grading System.
The photos presenting the items on our site are not contractual.
Article 4 - Orders :Orders can be placed via our website: www.diggazrecords.com
The sale will not be considered concluded until the customer has received an e-mail confirming the order and the full amount has been paid.
As part of its procedure for checking and accepting orders, Diggaz Records reserves the right to request additional supporting documents and the right to cancel or refuse any order from a customer with whom a previous order has proved to be in dispute.
Article 5 - Prices :The prices of our articles are indicated in Euros (incl. VAT), excluding shipping costs, and are payable in this currency (Euros) only.
Diggaz Records reserves the right to modify prices at any time, however, all items will be invoiced at the prices in effect on the site. www.diggazrecords.com at the time the order is placed, subject to availability.
Article 6 - Validation and payment :
The customer declares that he/she has read and accepted the present General Terms and Conditions of Sale and Use before confirming his/her order.
Consequently, any validation of the order by the customer implies acceptance of these General Terms and Conditions of Sale and Use.
All transactions carried out between the www.diggazrecords.com and its customers will be recorded by Diggaz Records and may be used as evidence.
To pay for the order, the customer may choose from the following methods of payment on final confirmation of the order:

Transaction security :
Regardless of the method of payment chosen, the banking information that the customer communicates to Diggaz Records will never circulate unencrypted on the Internet.
All transactions are secure and encrypted.
No credit card number is kept by Diggaz Records.
The same applies to PayPal payments.
Article 7 - Availability and delivery :Our offers of articles and prices are valid as long as they appear on the site. www.diggazrecords.comwhile stocks last.
If, however, an order is validated for an item that has become unavailable in the meantime, Diggaz Records undertakes to issue a credit note or refund at the customer's convenience. The latter will have been previously notified by e-mail of the unavailability of the item initially selected.
Items are delivered to the address indicated by the customer when registering on the site. www.diggazrecords.com.
The order will be processed at the latest within 3 days from the day of validation of the payment of the said order.
The choice of carrier (La Poste, Mondial Relay, private carrier) will be made by Diggaz Records according to the weight and/or volume of the items.
Diggaz Records reminds customers that it is their responsibility to ensure that they have provided all the information required for proper delivery of their order.
In the event that the information provided by the customer is erroneous or insufficient to ensure proper delivery of the order, Diggaz Records cannot be held responsible.
Diggaz Records reserves the right to cancel an order if the shipping address provided by the customer does not identify a fixed location of the buyer (eg. P.O. Box, Hotels, ...).
Any claim, whether it concerns a delivery error and/or non-conformity of the items in kind or in quality compared to the indications on the order form, must be expressed by the customer to Diggaz Records no later than the second working day following the date of delivery.
Any claim made after this deadline will be systematically rejected.

Article 8 - Warranties :As provided by law, the customer benefits from the provisions of the legal warranty against hidden defects.
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof shall not deprive the consumer of the legal warranty which obliges the professional seller to guarantee the consumer against all consequences of latent defects in the item sold.
The customer is expressly informed that Diggaz Records is in no way the producer of the items presented on the site. www.diggazrecords.comas defined in law no. 98-389 of May 19, 1998 on liability for defective products.
Consequently, in the event of damage caused to a person or property as a result of a defect in the article, only the producer of the article may be held liable by the customer.
Article 9 - Right of withdrawal :Under French law, the buyer has 14 days in which to withdraw from the contract.
The buyer may therefore return the item(s), provided it is in the same condition as when it was purchased.
In all cases, the buyer is responsible for return postage costs.
Upon receipt, the said return will be subject to a credit note or a refund of the amount of the returned goods, provided that the latter are in a condition consistent with that established at the time of purchase.
The buyer must return the unsatisfactory item(s) at his own expense within 14 working days.
This period runs from the day of delivery of the customer's order.
If this period expires on a Saturday, Sunday or public holiday, it will be automatically extended to the next working day.

In order for the buyer to benefit from the right of withdrawal, new items must not have been unsealed.
For a refund to be made, the returned item must be in the condition in which it was purchased, i.e. in its entirety, in its original packaging, complete and undamaged, and in perfect condition for resale.
No refund or exchange will be made for any item damaged or whose original packaging has deteriorated.
With the exception of return shipping costs, no penalty will be applied for exercising the right of withdrawal.
In the event of exercising the right of withdrawal, the purchaser has the choice of requesting either a refund of the sums paid or an exchange of the item.
In the case of an exchange, reshipment will be at the buyer's expense.
Computerized registers, kept in the computer systems of each party under reasonable conditions of security, will be accepted as proof of communications, contracts and payments between the parties.
Article 10 - Force Majeure :Neither party will have failed to fulfil its contractual obligations in the event that their performance is delayed, hindered or prevented by a fortuitous event or force majeure.
An act of God or force majeure shall be deemed to be any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which could not be prevented by the latter, despite all reasonable efforts.
The party affected by such circumstances will notify the other within 5 business days of becoming aware of them.
In order to examine the impact of the event and agree on the conditions under which performance of the contract will continue, the two parties will then meet within one month, unless this is impossible due to force majeure.
If the case of force majeure lasts for more than 3 months, these terms and conditions may be terminated by the injured party.
